RENTAL AGREEMENT

Max Property Occupancy At Any Time: 12

Max Number of Vehicles (including day-use guests): 4

Use the driveway for up to 4 vehicles. The county does not allow on-street parking for short-term rentals. County tow fines are $500 per car.

Cancellation by Guest(s): Full refund for cancellations up to 30 days before check-in. If booked fewer than 30 days before check-in, full refund for cancellations made within 48 hours of booking and at least 14 days before check-in. After that, 50% refund up to 7 days before check-in. No refund after that 

 

NOISE COMPLAINTS

Please be mindful of our neighbors during your stay.  City/County quiet hours are 9:00 pm to 7:00 am.  The City/County ordinance states that users of this unit are prohibited from disturbing the peace of the surrounding neighborhood.  Doing so is a violation of the City/County Code.  Fines are issued for disturbing the peace by code enforcement.  Disturbing the peace fines are $1000 to $5000 per incident.

City rules require that no radio receiver, musical instrument, phonograph, loudspeaker, sound amplifier, or any machine or device for the producing or reproducing of any sound may be operated on the vacation-rental property 24/7 unless it is within a fully enclosed structure (that means doors and, windows must be closed). The sound cannot be audible at the property line of the vacation rental property.

The use of an outdoor spa or any other activity that disturbs the peace during quiet hours from 9 pm to 7 am is prohibited.  Doing so is a violation of the City/County ordinance and, may result in a county-issued nuisance fine of $1000 to $5000 and/or, eviction.

City/County code quiet hours are in place to ensure that everyone can enjoy a peaceful night's sleep.  We care a lot about maintaining good relationships with our community.  We appreciate you following the rules during your stay.

County code does not allow this property to be used for commercial activity.  That includes but, is not limited to weddings, wedding receptions, corporate retreats, business meetings or conferences, fraternity parties or, any other similar gatherings.  These types of gatherings require a county-issued permit.

Failure to comply with these county requirements including parking, occupancy standards, and public and private nuisance standards is a violation of the county code. Such a violation may result in enforcement actions to address the violation. These may include fines, actions to abate the nonconformity, the institution of criminal, civil, or administrative action, or under certain circumstances, the calling of law enforcement for the removal of guests and their vehicles from the property to the extent authorized by law.

 

 

TRESPASSING

Please make sure not to trespass on neighbors' property. You could be fined a minimum of $1000 and up to $5000 by the County. Here is a map of the property boundaries. 

Please observe neighbors' no trespassing signs.

FIRES AND DAMAGES

1.Fire screens or airtight doors should be closed at all times. Embers may pop and shoot out.

2.NO CANDLES PLEASE! Do not overload fireplace with wood as this can cause a chimney fire.

3.Lighter fluid or gasoline is absolutely forbidden to use in a fireplace. Wadded newspaper is a good fire starter or fire bricks/logs. Please NO PINE CONES! Pine cones are dangerous

4.Make sure the fire is out and the screen or door is closed prior to going to bed.

5.Outdoor fires are prohibited. The Fire Pit and BBQ are propane - no wood or, charcoal.

6.Be careful of drying clothes or winter equipment next to fireplace or heaters.

7.Leave the ashes in the fireplace. We will take care of this. For extended stays, you can use the ash can provided but remove only when embers are cooled.

8.Fireworks are prohibited anywhere in Big Bear. The neighbors WILL call the police so please don't.

9.DO NOT chop wood on the fireplace hearth. It will break and you will lose your FULL deposit. Chop outside if needed.

 

DEPARTURE CHECKLIST

1. TRASH REMOVAL : There is a dumpster with a locking mechanism at the bottom of the driveway. Place all of your trash in the dumpster prior to departure.  Because of wild animals from the National Forest MAKE SURE TO SECURE THE LOCK WITH THE CARABINER TO PREVENT ANIMALS FROM GETTING INTO THE DUMPSTER. You will be charged for cleanup if you leave unsecured trash outside that wild animals get into. You will also be charged if the cleaners need to clean up your trash and take it to the dumpster. $50 Non-Compliance Fee

2.LOCK ALL WINDOWS/DOORS - Be sure they are closed and locked. The front door and, the living room patio door may need to be firmly shut before they lock.

3.HEAT: In wintertime before leaving, turn heat down to 55 degrees. PLEASE DO NOT TURN OFF

4.Please PICK UP and DISPOSE of ALL YOUR CIGARETTE BUTTS and TRASH outside. $25 Non-Compliance Fee

5.BEDDING and TOWELS: Please leave the beds you have used unmade. Please leave dirty linens and towels in the bathroom or, near the laundry room.

6.DISHES: Wash and put away all dishes. DO NOT put dirty dishes back in the cupboards. $50 Non-Compliance Fee.

7.FOOD: Please remove all perishable food you brought with you. $25 disposal fee.

8.MOVE ALL FURNITURE to original spots. $25 minimum fee

9.Our property is NON SMOKING. Evidence of smoke indoors = Full forfeiture of deposit

10.If you used it please scrub BBQ rack clear of food

11.Turn off all TVs, Arcade Games and, other recreational appliances before departure

12.Be sure to TAKE ALL OF YOUR BELONGINGS. A min fee of $25 will be applied to return all items left behind.

 

Renters who violate the terms of the agreement may be subject to eviction and forfeiture of rental fees.

Liability:

Assumption of Risk: By accepting this vacation rental agreement, you acknowledge and assume all risks associated with your stay at the cabin, including but not limited to activities within the cabin, on the property, and in the surrounding mountainous and forested areas. This includes assuming responsibility for the safety and well-being of yourself, as well as any accompanying guests, including children.

Property Use: You understand and agree that the use of the cabin, property facilities, and any amenities provided, such as outdoor equipment, is at your own risk. The property owner and its representatives shall not be held liable for any injuries, accidents, or damages that occur as a result of the use or misuse of these amenities. It is your responsibility to ensure the safety and supervision of any accompanying guests, especially children, while using these amenities.

Mountain and Forest Activities: Engaging in mountain and forest activities, including hiking, wildlife viewing, and outdoor sports, involves inherent risks. You assume all responsibility and liability for any injuries or incidents that may occur during these activities, both for yourself and any accompanying guests, including children. It is recommended that you adhere to all safety guidelines, use proper equipment, and exercise caution while participating in such activities.

Outdoor Fire Pit, BBQ, and, Hot Tub Use: You understand that using the outdoor fire pit, BBQ, and Hot Tub carries inherent risks. You are responsible for your safety and the safety of your guests, including children, while using these amenities. The property owner and its representatives shall not be held liable for any injuries, accidents, or damages that occur as a result of the use or misuse of the fire pit, BBQ and, Hot Tub. It is essential to supervise children at all times and ensure compliance with fire safety rules.

Guest Responsibility: As a guest, you are responsible for your safety and the safety of your accompanying guests, including children. It is your responsibility to exercise caution, act responsibly, and abide by all rules, guidelines, and warnings provided by the property owner or its representatives. This includes ensuring the appropriate supervision and safety measures are in place for any children in your care.

Third-Party Activities and Services: The property owner and its representatives are not responsible or liable for any injuries, accidents, damages, or losses incurred during activities or services arranged or provided by third parties, including but not limited to excursions, tours, or transportation services. It is your responsibility to exercise caution and assess the safety measures of any third-party activities or services before participating, especially when children are involved.

Guest Verification: As stated in our listing, in addition to the rental agreement you will be asked to complete guest verification. This is done through Superhog, a third-party provider. Superhog will contact you via email and/or text. At that time you will also be given the choice between a security deposit or a non-refundable damage waiver. Please complete this prior to your stay to provide a smooth check-in.
